Advocacy Update: Bill 13 – The Residential Tenancies Amendment Act

BOMA has identified that Bill 13 – The Residential Tenancies Amendment Act – along with the Government of Manitoba’s proposed amendments to Residential Rent Regulation, will have significant implications for building owners, managers, and service providers.

Proposed amendments to Residential Rent Regulation would increase the number of units subject to rent control. Units renting above $1,670 per month are currently exempt from rent control. The provincial government plans to increase the monthly rent exempt threshold to $2,000 per month.

Additional amendments to Residential Rent Regulation would reduce the portions of capital expenditures that a landlord is entitled to claim – as part of an above-guideline rent increase application – by 50%. Currently, for example, a $100,000 eligible capital project is fully claimable. The proposed legislation would reduce that claimable cost to $50,000.

In BOMA’s view, these changes would significantly reduce the incentive for owners of multi-family properties to invest in their buildings. Furthermore, for BOMA’s allied members who support or work with multi-family building owners, this would almost certainly translate into fewer projects.

The BOMA office is communicating with the Government of Manitoba to express our industry’s concern with the proposed amendments. We encourage industry stakeholders – those involved in owning, managing, building and maintaining multi-family properties – to voice their concerns regarding the proposed changes via the ‘Engage MB’ webpage, available here.
