Topic: Upcoming Changes to the Builders’ Lien Act (Prompt Payment): Implications for the CRE Industry

The previous Manitoba government passed amendments to the Builders’ Lien Act to add prompt payment and dispute adjudication systems to the construction industry, similar to existing systems in Ontario, Saskatchewan and Alberta. While not yet in force, the new legislation contains a number of key changes aimed at ensuring the timely payment of contractors and subcontractors on construction projects, and a new dispute resolution system – adjudication.
Building owners and managers will need to be aware of the upcoming changes and how the new legislation will impact the way their construction projects are procured, contracted and managed, including project financing considerations. Andrew Konopelny of MLT Aikins LLP has experience in advising owners on complying with and managing recent prompt payment changes in other provinces and is looking forward to sharing his knowledge and experience with BOMA.
